Presentation

Self-Defence in Cyber Incidents

Original title: Siber Olaylarda Meşru Müdafaa

The presentation examines whether cyber attacks can give rise to the right of self-defence under Article 51 of the UN Charter. It addresses the armed-attack threshold, the scale and effects test and the cross-border element of an attack, and discusses the role of non-state actors with data from the Verizon 2013 Data Breach Investigations Report. The final part considers companies' active cyber-defence practices and the self-help doctrine.
